Fiancee Visa (K-1/K-2)

Premium Package

THIS FEE AGREEMENT made and entered into this___________day of_____________________________, 2007, between _____________________________, hereinafter referred to as "Client", and A Foreign Affair, hereinafter referred to as "AFA" with offices at 7227 N. 16th Street, Ste. 240, Phoenix, Arizona 85020. Legal services will be performed by the Law Offices of Ms Jones, hereinafter referred to as "Attorney", as an in-house counsel for AFA.

IT IS UNDERSTOOD THAT ATTORNEY CANNOT REPRESENT CLIENT IN PRIVATE MATTERS, ATTORNEY IS NOT A "PRIVATE ATTORNEY" OF THE CLIENT AND CLIENT HAS BEEN ADVISED TO SEEK A LEGAL ASSISTANCE OF AN INDEPENDENT COUNSEL.

1. Beginning of Representation

Representation in K-1 process will start upon signature of the Agreement by Client. Attorney will initiate the process by taking necessary steps in order to assemble K-1 package.

2. End of Representation

Representation will end upon the Embassy interview in a home country of Fiancee.

3. Preparation and assembly of the I-129F Petition

Once we receive all the documents and information from you, we will prepare the I-129F Petition. We will not submit an I-129F Petition until we are absolutely confident that it is complete and there are no problems that may cause a delay. Once we are confident that the petition is ready for submission we will Express Mail it to you for your final signature. You will sign it as indicated by our instructions and send it back to our Attorney so that Attorney may check it one last time and file it with the appropriate Service Center.

4. Contact with your Fiancee.

Before submitting the I-129F Petition, we will make sure that your Fiancee is aware of every step of the process. Our office will communicate with your Fiancee throughout the whole process by phone, fax or e-mail.

• Fiancee is entitled to three personal conversations (phone/e-mail/fax) with Attorney:
  1. at the beginning of the process (before K-1 package is filed);
  2. during the process (after K-1 package has been filed and only upon Client's request);
  3. 10 days before K-1 interview.
• Petitioner is entitled to an unlimited access to Attorney's assistants and AFA.
• Fiancee is entitled to an unlimited access to Attorney's assistants and AFA.
5. Follow up once the Petition has been submitted.

We will continue to monitor your petition until approval while your case is in the United States Service Center. We will keep you apprised of the progress as the petition advances through our web site and e-mails. If the petition is not approved in a reasonable amount of time for the specific service center we will make inquires on your behalf as to the status of the petition. Additional fees might be applicable.

6. Embassy's packet for Fiancee

The Embassy will mail your Fiancee a packet including certain forms that must be completed by the Fiancee. Our office will complete the forms for the Fiancee and mail them to your Fiancee with a copy of a complete package prior to her receiving them from the Embassy.

7. Embassy Communication

If necessary, our office will contact the U.S. Embassy located in the home country of your Fiancee in order to schedule K-1 interview. Additional chargers might be applicable.

8. Preparation for the Embassy interview.

One of our staff will also meet personally with the Fiancee upon her request. We will also assist her with the logistics of arranging the medical examination and getting to the embassy for the interview. (Personal meetings and assistance available only in Russia, Ukraine and Colombia, in all other countries we will facilitate the fiancee by tele-conferencing). Attorney will go over her paperwork and discuss what will take place at the interview one final time. Additional charges might be applicable.

9. Translations.

Translation services of all necessary documents for the K-1 package are not included in the price of the package.

10. The Client's Responsibility.

Client must fully cooperate with our office and provide all relevant information and necessary documents for the Fiancee visas process. Attorney may withdraw from your representation if you do not cooperate with our office and/or are planning to commit fraud or other crimes. In this case, the Fee shall not be refundable.

11. Costs & Expenses.

Legal cost for Premium Package is $1500.00. Filing fees are NOT included. Filing fees will be paid directly to "the USCIS" by Client.

Client will be responsible for additional fees, such as: mailing fees, copying fees, communication fees and any others expenses in connection with K-1 process.

In the event, when Client needs a "joint sponsor", additional fee of $250.00 will be charged. Joint sponsor will be needed if Client's total income shown on tax return form ( Form 1040/1040A) is negative or is lower than required by the USCIS.

Legal cost for Fiancee's 1st child is included in the price of package. Client will be charged for any additional child of Client's Fiancee ($100.00 per additional child)

12. Timing

Client understands that AFA and Attorney will proceed with K1 package in a timely manner upon Client's payment.
It is sole responsibility of the Client to provide all necessary documents and information to Attorney in order for Attorney to assemble K-1 package in a timely manner (1-2 weeks). Client's failure to fully cooperate with AFA or Attorney will delay the process not at fault of Attorney.

Attorney processes K-1 package on "first come - first served" base. Please, allow Attorney from 7 to 14 days for the processing of the Client's documents.

For certain cases expedited process is available. Availability will be determined by Attorney. In this case, "expedited fee" will be charged.

13. Communication with Attorney's office

Attorney is responsible for providing necessary updates to Client about K-1 case in a timely manner (24 hours). All phone calls will be returned within 24 hours. Client understands that Client will contact Attorney's office ONLY if Client has not received a response after 24 hours of his enquiry.

E-MAILS - IS A PREFERABLE WAY OF COMMUNICATION WITH ATTORNEY'S OFFICE!

14. Deposit

Client has a right to pay a deposit of a minimum of $500. It is understood that AFA and its Attorney will not start any work on the K-1 process until a complete amount is paid by Client. It is an absolute responsibility of Client to have all the funds available for AFA upon signing of the Agreement.

15. Confidentiality.

All information received from you, your Fiancee or your representative on your behalf in writing or orally is confidential and shall be used only by our office for the purpose of the completion of the Fiancee visa process.

16. Refunds.

Client is entitled to a refund in the event if Client cancels the process with or without any reason:

• 85% refund - Clients received package and cancels service;
• 65% refund - Client received package, all forms have been completed and Client cancels service;
• NO refund - Client received package, all forms and supporting documents are assembled by Attorney;

Client understands that the mailing and translation fees are non-refundable.

17. Signature.

Client acknowledges by his/her signature that he/she has read and agreed to the provisions of this Agreement. Client also acknowledges that he/she has had the opportunity to have any questions answered and this Agreement fully explained to Client's satisfaction. Client also acknowledges that he/she has been given a copy of this Agreement.
